New Legal Provision for High-Value Real Estate Transactions in Nepal
The Government of Nepal has introduced and implemented a regulatory framework for professional real estate transactions under Section 26(A) and 26(B) of the Land Revenue Act, 2034 (मालपोत ऐन, २०३४). Under the applicable Government notification, firms, companies, or organizations conducting covered real estate transactions exceeding NPR 3 crore in a single transaction in designated metropolitan and sub-metropolitan areas are required to obtain the applicable licence to conduct such transactions.
The new framework is intended to make high-value property transactions more transparent, accountable, systematic, and professionally managed, while strengthening regulatory oversight of real estate transactions.
The Government has also established a licensing mechanism for eligible firms and companies engaged in regulated real estate transactions. The applicable requirements depend on the transaction, location, parties involved, and prevailing Government notifications and procedures.
